These Terms of Service ("Terms") govern your use of the StatementSwift marketing website at www.statementswift.com, the product application at app.statementswift.com, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Definitions
- "StatementSwift", "we", "us", "our" refers to the operators of the Service.
- "You", "User" refers to any person or entity accessing or using the Service.
- "Merchant of Record" refers to Polar (polar.sh), which processes payments, handles taxes, and manages billing on our behalf.
2. Acceptable Use
You agree to:
- Use the Service lawfully and in accordance with these Terms.
- Not attempt to disrupt, overload, reverse engineer, or exploit the Service.
- Not upload files that contain malware, are fraudulent, or infringe on third-party rights.
- Not circumvent usage limits, quota enforcement, or anti-abuse controls.
- Not resell, redistribute, or sublicense access to the Service without written permission.
3. Accounts
The product app requires an account. You are responsible for maintaining the security of your authentication credentials and for all activity under your account.
4. Subscriptions & Billing
Paid plans are billed via Polar, our Merchant of Record. Polar handles payment processing, invoicing, sales tax, and refunds. By subscribing, you also agree to Polar's Terms of Service.
- Subscriptions renew automatically at the end of each billing period (monthly or yearly).
- You may cancel at any time; access continues until the end of the current billing period.
- Plan downgrades take effect at the start of the next billing period.
- Unused conversion quota does not roll over between billing periods.
- We reserve the right to change pricing with reasonable notice. Existing subscriptions remain at their current price until renewal.
5. Free Preview
The free preview converter on the marketing site is provided for evaluation purposes. It is subject to per-session usage limits and anti-abuse controls. We reserve the right to modify or discontinue the free preview at any time.
6. Intellectual Property
All content, branding, code, and design of the Service are owned by StatementSwift or its licensors and are protected by applicable intellectual property laws.
Your data: You retain full ownership of all files you upload and data extracted from your statements. We claim no intellectual property rights over your content. We use your uploaded files solely to provide the conversion service.
7. Service Availability & Modifications
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or the accuracy of extraction results.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will make reasonable efforts to notify active subscribers of material changes.
8. Limitation of Liability
To the maximum extent permitted by law:
- StatementSwift is not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total aggregate liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not liable for errors, inaccuracies, or omissions in extracted data. You are responsible for verifying extracted transaction data before relying on it for financial or regulatory purposes.
9. Indemnification
You agree to indemnify and hold harmless StatementSwift from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
10. Account Termination
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. You may request account deletion at any time by contacting us. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.
11. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which StatementSwift operates. Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes may be submitted to binding arbitration or the courts of competent jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will be revised accordingly. Continued use of the Service after changes constitutes acceptance. For material changes, we will make reasonable efforts to notify you via the product app or email.
